Privacy Policy

Bergkvist Siljan is responsible for the personal data processed under our brand. This privacy policy describes how we use, store, and process personal data in a lawful, fair, and transparent manner in accordance with the new EU General Data Protection Regulation (GDPR) effective from May 25, 2018. It also outlines the rights you have as a visitor to Bergkvist Siljan’s website, supplier, contractor, customer, and/or their contact person.

Personal Data We Collect

  • Name (for forest and property owners, and if applicable, spouse/authorized representative and private contractors)

  • Property registration (forest owners)
  • Certificate/reference numbers
  • Bankgiro, plusgiro, or account number
  • Title, position, or other work-related information
  • Correspondence containing personal data (via phone, letter, or email)

According to GDPR, personal data may only be collected for “specific, explicitly stated, and legitimate purposes.”

Legal bases for our data processing:

  • Contract performance: We process personal data as necessary to fulfill a contract with the data subject or take pre-contractual steps at their request.
  • Legal obligations: We process data to meet legal requirements, such as accounting and labor laws.
  • Legitimate interest: We process personal data when necessary to fulfill agreements, manage invoicing and administration, handle complaints, and provide customer service. We balance our interest against your rights (legitimate interest assessment). We may contact you via post, SMS, MMS, phone, or email.

Storage of Personal Data

Bergkvist Siljan takes all reasonable measures to ensure your personal data is processed and stored securely. We aim to minimize stored data and retain it only as long as necessary under applicable law or regulations (e.g., Accounting Act, Swedish Forest Agency).

Data is stored on secure servers and access is restricted internally. As we operate within a corporate group with shared functions, personal data may be disclosed to other companies within the group.

Data may also be disclosed to data processors where absolutely necessary to perform work tasks (e.g., system support or operation). Data processors can access, organize, and store personal data per our instructions.

Example: Forest contractors may receive contact information for landowners where work is carried out.

We retain personal data only as long as necessary for its purpose. Retention periods vary by purpose. If not stated otherwise, most data is kept for the duration of your business relationship with us. Data required for legal obligations is retained as stipulated by law.

Transfer of Personal Data to Third Countries

In some cases, personal data may be transferred to a data processor in a country outside the EU/EEA. We ensure adequate protection either through an EU Commission adequacy decision or suitable safeguards such as:

  • The receiving company has joined the EU-US Privacy Shield

You may also be entitled to compensation for any violation of your rights, either directly from us or through legal action.
